General Terms of Business

1. Contract Agreement Contract language is German. The presentation of the products in the online-shop does not constitute a legal binding offer rather a non-binding online catalogue. After entering your personal data and by clicking the button “send order” in the final step of the ordering process, you place a binding order for products contained in the shopping cart. The confirmation for the receipt of the order succeeds directly after sending the order. The sales agreement materialises with our separate order confirmation via email or fax or first with delivery of the goods. All prices are calculated including sales tax. In general the following applies: The delivered goods remain possession of www.trashcan24.com until fully paid. Descriptive product information such as illustrations, drawings, descriptions, data about measurements, weight, performance and usage that can be found in brochures, on CD´s or similar documentation are subject to confirmation as far as they have not been explicitly designated to be binding. This is especially applicable in the case of changes and improvements that serve technical advancement. Slight aberration of such product descriptive information deems to be approved and do not affect the fulfillment of contracts, as far as they are not unacceptable for the buyer.

At the earliest the deadline begins with receipt of the goods and detailed instructions in the written form. 4. Cancellation Consequences In the case of an effective cancellation the services actually rendered on both sides are to be granted back and if necessary attained applications (e.g. interest) returned. Should the services actually rendered not be able to be granted back to us totally or partially or only in a worse condition, a value replacement must be achieved as far as that goes. Value replacement must not be achieved if the worsening of the goods can be solely attributed to their examination as it would have been possible for you in a store. Incidentally you as a customer can avoid the duty of value replacement by not using the item as an owner and by avoiding everything that can interfere with the value of the goods. Package-transportable goods are to be sent back at our risk, non-package-transportable goods will be picked up. You must fulfil obligations for reimbursement within 30 days after dispatch of your cancellation. You bear the costs for the return consignment if the delivered goods correspond with the ordered ones and if the price of the returning goods does not exceed 40 Euro or if, in the case of the price of the goods being higher, you did not render your return service or a contractually agreed upon partial payment at the time of cancellation.

The right of cancellation does not apply for goods which are manufactured according to customer specifications or which are clearly specific to personal requirements or which are not fit for a return consignment as a result of their condition or which are quickly perishable or whose expiration date has expired, * audio or video recordings or software, as far as the delivered data carriers have been unsealed by you, * newspapers and magazines.

6. Warranty, Guarantee and Notice of Defect Trashcan24.com offers a 24-month warranty on all items according to the following terms. Additional guarantees from the manufacturers are not affected hereby. Apparent deficiencies of the goods, also damages in transit, we ask you to inform www.trashcan24.com in a written form or via e-mail immediately, at the latest however within 2 weeks after delivery of the goods. By failure to meet this deadline warranty rights due to apparent deficiencies are excluded. Please inform us of deficiencies that are not detected within this deadline despite meticulous examination immediately after detection in a written form to the address listed in the footer text or via e-mail to the e-mail address info@trashcan24.com. In the case of entitled notification of defects we will of course carry out, according to your choice, free rectification of the defects or replacement. However, is the type of post-fulfillment you have chosen only achievable with disproportional costs, we can refuse these. Should the rectification of the defects alternatively the replacement fail twice, you may demand your choice of either decrease in payment (reduction) or cancellation (redhibitory action) of the contract. For items which are identified as second-hand goods a 1-year warranty is granted. Further demands do not exist.
